Terms of service

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "your") and Théo Grelet ("Wotter," "we," "us," or "our"), governing your access to and use of the Wotter mobile application and related services (collectively, the "Services").

By downloading or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

We may update these Terms from time to time. If we make material changes, we will notify you through the app. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 16 years of age (or the equivalent minimum age in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement. If you are a parent or guardian, you may authorize a minor under your supervision to use the Services, and you accept full responsibility for their activity.

2. No Account Required

The Services do not require you to create an account, sign in, or provide an email address or password. Your hydration data is stored locally on your device and, if you enable it, synchronized with Apple Health. You are responsible for the security of your device and for any backups that include Wotter data.

3. Description of the Services

Wotter is a mobile application that helps you track your daily water consumption. Wotter is incarnated by Lou, a friendly otter who encourages you to reach your hydration goals. The Services include:

  • Hydration tracking: You log your drinks, and Wotter records your intake against a daily goal.
  • Reminders: With your permission, Wotter can send you local notifications to remind you to drink water.
  • Apple Health integration: With your permission, Wotter can read from and write water intake data to Apple Health.
  • Home Screen widget: Wotter provides a widget that displays your daily progress.

Wotter is a wellness and habit-tracking tool. It is not a medical device and does not provide medical, nutritional, or hydration advice. See Section 8 (Disclaimers) for more detail.

4. Acceptable Use

You agree not to:

  • Use the Services for any purpose other than personal, non-commercial hydration tracking.
  • Attempt to reverse-engineer, decompile, or extract the source code of the app.
  • Use automated tools, bots, or scripts to interact with the Services.
  • Create multiple purchases or use fraudulent means to circumvent subscription restrictions.
  • Interfere with or disrupt the integrity or performance of the Services.

5. Premium Subscriptions

5.1 Free and Premium features

Wotter offers a set of core features for free. Certain features are available only with a Premium subscription. The specific features included in each tier are presented in the app.

5.2 Plans and pricing

Wotter offers Premium subscription plans. Current pricing is displayed in the app at the time of purchase. Specific plan details, including any monthly and annual options, are presented in the app before purchase.

5.3 Billing and renewal

Premium subscriptions are billed through Apple's in-app purchase system. By subscribing, you agree to Apple's terms for in-app purchases and subscriptions.

  • Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings.

5.4 Refunds

Refunds for subscriptions are handled by Apple in accordance with Apple's refund policies. We do not process refunds directly. To request a refund, visit Apple's support page or contact Apple directly.

5.5 Price changes

We may change subscription pricing at any time. Any price change will take effect at the start of your next billing period after the change. Apple will notify you in advance of any price increase, and your continued subscription after that notification constitutes acceptance of the new price. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

6. User Content

Any data you create or input within the Services — including logged drinks, daily goals, and settings — remains yours. Because Wotter stores this data locally on your device and, optionally, in Apple Health, we do not access, store, or process it on our own servers. You are solely responsible for managing and backing up this data.

7. Intellectual Property

The Wotter app, including its design, branding, logos, the Lou character, user interface, and software, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in our intellectual property, except for the limited license to use the Services as described herein.

If you provide us with suggestions, ideas, or feedback about the Services ("Feedback"), you grant us an unrestricted, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Services without any obligation to you.

8. Disclaimers

8.1 Not medical advice

Wotter is a wellness and habit-tracking tool intended for general informational purposes only. Wotter does not provide medical, nutritional, or hydration advice, and is not a substitute for professional advice. Individual hydration needs vary based on age, health, activity, climate, and other factors. Consult a qualified healthcare professional before making decisions about your fluid intake, particularly if you have a medical condition affecting hydration.

8.2 Data accuracy

Hydration goals and intake figures shown in the app are estimates based on the data you enter and general assumptions. We do not guarantee their accuracy. You are responsible for verifying the data you log.

8.3 Service availability

Certain features depend on device permissions (notifications, Apple Health) and on Apple's in-app purchase infrastructure. We do not guarantee that all features will function at all times.

8.4 General disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WOTTER, ITS OWNER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION.

10. Indemnification

You agree to indemnify, defend, and hold harmless Wotter and its owner from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party right.

11. Termination

You may stop using the Services at any time by deleting the app. Deleting the app removes locally stored Wotter data from your device; data written to Apple Health remains subject to your Apple Health settings, and active subscriptions must be cancelled separately through your Apple ID account settings.

We may suspend or terminate your access to the Services at any time if we reasonably believe that you have violated these Terms or engaged in abusive or fraudulent behavior. Sections that by their nature should survive termination will continue to apply, including Sections 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and 13 (Dispute Resolution).

12. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law principles.

If you are a consumer resident in the European Union or the United Kingdom, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer that cannot be waived or limited by contract.

13. Dispute Resolution

13.1 Informal resolution

Before initiating any formal proceedings, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13.2 Jurisdiction

If informal resolution is unsuccessful, any dispute arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection laws in your jurisdiction grant you the right to bring proceedings in a different forum.

13.3 EU consumers

If you are a consumer resident in the European Union, you may also use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.

14. General Provisions

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Services and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force majeure. We are not liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet or infrastructure failures, or third-party service disruptions.
